Non-Jurisdictional Affirmative Defense
That the statute of limitations has run is a non-jurisdictional affirmative defense, see Flagg v. Stryker Corp., 819 F.3d 132, 143 (5th Cir. 2016) (Haynes, J., concurring in part), not a jurisdictional pre-requisite. (Fn. 5).
