  Art. 25 Official and business secrets

¹ The competition authorities are bound by the rules on official secrecy.

² They use information obtained in the performance of their duties only for the purpose for which it was obtained or for the purpose of the investigation.

³ The competition authorities may provide the Price Supervisor with any information required for the accomplishment of the latter's duties.

⁴ The competition authorities' publications may not reveal any business secrets.

Remains an open question whether al. 2 allows use of data from one Commission’s proceeding in another Commission’s proceeding.

Mangels Relevanz in casu braucht hier nicht auf den Meinungsstreit eingegangen zu werden, ob Art. 25 Abs. 2 KG die Verwendung von in einem Verfahren der Wettbewerbsbehörden gewonnenen Erkenntnissen in anderen Verfahren der Wettbewerbsbehörden ausschliesst oder nicht.
