Van de Kamp v. Goldstein

Immunity, prosecutor: scope of a prosecutor’s absolute immunity from claims asserted under Rev. Stat. §1979, 42 U. S. C. §1983. Prosecutors are absolutely immune from liability in §1983 suits brought against prosecutorial actions that are “intimately associated with the judicial phase of the criminal process” (U.S.S.Ct., 26.01.09, Van de Kamp v. Goldstein, J. Breyer, unanimous).

Immunité du Procureur dans le procès pénal : elle est très large et complète dans les actions en dommages-intérêts dirigées directement contre lui pendant la phase judiciaire du procès pénal (et non dirigées  contre la collectivité publique) au sens du paragraphe 1983 U.S.C. 42.
