Corporations: standing



Corporations: standing: an organization (unincorporated association, corporation, union, etc.) has standing to challenge government action that causes injury to the organization itself. An organization also has standing to challenge government actions that cause an injury in fact to its members if the organization can demonstrate the following three facts: 1. There must be an injury in fact to the members of the organization that would give individual members a right to sue on their own behalf; 2. The interests it seeks to protect are germane to the organization's purpose; 3. Neither the nature of the claim nor the relief requested requires participation of the individual members in the lawsuit (Warth v. Seldin, 422 U.S. 490, cf. Hunt v. Washington Apple Advertising Commission, 432 U.S. 333 (1977), Burger, C.J., delivered the opinion of the Court, in which all Members joined except Rehnquist, J., who took no part in the consideration or decision of the case).

Qualité pour agir des personnes morales : elle est donnée si la personne morale est elle-même lésée par un acte gouvernemental, ou si ses membres sont lésés. Dans ce dernier cas, les membres de la personne morale doivent être eux aussi lésés, la lésion doit être en lien avec le but de l'organisation, et ni la nature de l'action, ni le remède sollicité du tribunal ne requiert la participation dans le procès des personnes physiques membres de la personne morale qui agit en justice.
