U.S. v. Hayes

Gun Control Act of 1968, prohibition on possession of a firearm by convicted felons to include persons convicted of “a misdemeanor crime of domestic violence". A domestic relationship, although it must be established beyond a reasonable doubt in a §922(g)(9) firearms possession prosecution, need not be a defining element of the predicate offense (U.S.S.Ct., 24.02.09, U.S. v. Hayes, J. Ginsburg).

Loi fédérale de 1968 sur le contrôle des armes à feu, interdiction faite à  un condamné pour une infraction assimilée à un crime de posséder une telle arme. L’interdiction s’étend à celui condamné pour violence domestique, même si cette dernière condamnation s’analyse en une contravention et non en un crime.
