P. v. Anderson



Burglary : the substantive crime of burglary is defined by its elements as: (1) entry into a structure, (2) with the intent to commit theft or any felony.  (§ 459; see also CALCRIM No. 1700.)  We refer to this simplified description of burglary by way of example.  The burglary statute includes within its scope entry into “any house, room, apartment, tenement, shop, warehouse, store, mill, barn, stable, outhouse or other building, tent, vessel, . . . floating home, . . . railroad car, locked or sealed cargo container, whether or not mounted on a vehicle, trailer coach, . . . any house car, . . . inhabited camper, . . . vehicle . . . , when the doors are locked, aircraft , . . . or mine or any underground portion thereof . . . .”  (§ 459.). If these elements are proven, the crime of second degree burglary has been committed.  (§§ 459, 460, subd. (b).)  However, if, in addition to these elements, there is also proof that the structure was inhabited at the time of the entry, the crime is elevated from second degree to first degree burglary.  (§ 460, subd. (a)) (Cal. S. Ct., 23.07.09, P. v. Anderson, S152695).

Burglary : cette infraction se définit ainsi en droit californien : (1) entrée dans une structure, (2) avec l’intention de commettre un vol ou n’importe quel felony. On peut concrétiser cette définition simple par des exemples. L’infraction est réalisée en cas d’entrée dans toute maison, chambre, appartement, lieu loué, boutique, dépôt, magasin, moulin, étable, autre bâtiment, tente, bateau, maison flottante, wagon, conteneur fermé ou scellé, monté ou non sur un véhicule, caravane, toute maison servant de domicile, campement inhabité, véhicule dont les portes sont fermées, avion, mine, ou toute partie souterraine d’une mine. Si ces éléments sont prouvés, le crime de Burglary au second degré a été commis. Cependant, si, en plus de ces éléments, la preuve est apportée que la structure était habitée au moment de l’entrée, le crime est élevé de Burglary au second degré à Burglary au premier degré.
