Estoppel: Equity: Equitable remedies: Deadline: Statute of limitation:

(…) As an alternative to his statutory arguments, J.M. asserts claims to equitable relief under the doctrines of estoppel and tolling.  The elements of equitable estoppel have been applied in the government claims context.  “(1) The party to be estopped [here, the District] must be apprised of the facts; (2) he must intend that his conduct shall be acted upon, or must so act that the party asserting the estoppel had a right to believe it was so intended; (3) the other party [here, J.M.] must be ignorant of the true state of facts; and (4) he must rely upon the conduct to his injury.”  (Driscoll v. City of Los Angeles (1967) 67 Cal.2d 297, 305 (Driscoll); see Orr v. City of Stockton (2007) 150 Cal.App.4th 622, 635.)

Equitable estoppel generally requires an affirmative representation or act by the public entity.  (Tammen v. County of San Diego (1967) 66 Cal.2d 468, 480; see In re Marriage of Comer (1996) 14 Cal.4th 504, 523.)

Estoppel en rapport avec un délai :

La théorie de l'estoppel s'applique aussi dans le cadre d'une procédure contre l'administration. En l'espèce, un délai avait été manqué et le requérant cherchait à obtenir la restitution de ce délai en invoquant la théorie de l'estoppel, soumise aux conditions suivantes : 1) la partie adverse à celle qui invoque estoppel doit être informée des faits, 2) dite partie doit vouloir que son adverse partie agisse sur la base de sa perception erronée, ou doit agir d'une manière telle que l'autre partie était en droit de se fonder sur ce qu'elle constatait, 3) la partie qui invoque estoppel doit ignorer la situation réelle, 4) dite partie doit se fier à la conduite adverse, conduite qui mène au préjudice.

De manière générale, estoppel implique une représentation ou un acte positif de l'administration.
