(…) Though we have cautioned that statutory preambles do not impose substantive requirements (Briggs, supra”, 19 Cal.4th at p. 1118), our task when interpreting legislation is to effectuate the statutory purpose –– and “statements of purpose in a statute’s preamble can be illuminating,” particularly if a statute is ambiguous (Yeager v. Blue Cross of California (2009) 175 Cal.App.4th 1098, 1103).

P. v. Traylor, S157820



Interpretation: we further explained in Burris that, although the rules of grammar and the canons of construction are useful tools in divining a statute’s purpose, the normal principles of statutory interpretation may not, in particular circumstances, disclose a clear legislative intent behind the often-amended language of section 1387(a).  In such a situation, we said, courts must remember that “ ‘those who write statutes seek to solve human problems.  Fidelity to their aims requires us to approach an interpretive problem not as if it were a purely logical game, like a Rubik’s Cube, but as an effort to divine the human intent that underlies the statute.’ (p. 9) (Cal. S. Ct., 13.07.09, P. v. Traylor, S157820).

Interprétation : bien que la grammaire et les règles traditionnelles d’interprétation des lois sont des outils utiles à la détermination du but d’une loi, il peut arriver dans des circonstances particulières que ces règles ne révèlent pas d’intention législative claire, par exemple s’agissant d’une loi souvent amendée. Dans de telles situations, les Tribunaux doivent garder à l’esprit que ceux qui rédigent les lois cherchent à résoudre des problèmes humains. La fidélité au but recherché par la loi implique de ne pas approcher un problème d’interprétation comme s’il ne s’agissait que d’un pur jeu de logique, mais implique un effort de recherche de l’intention humaine sous-jacente à la loi.
