Indiana State Police Pension Trust v. Chrysler LLC



Stay : in determining whether to grant a stay, we consider instead whether the applicant has demonstrated “(1) a reasonable probability that four Justices will consider the issue sufficiently meritorious to grant certiorari or to note probable jurisdiction; (2) a fair prospect that a majority of the Court will conclude that the decision below was erroneous; and (3) a likelihood that irreparable harm will result from the denial of a stay”; “a stay is not a matter of right, even if irreparable injury might otherwise result.” (U.S.S.Ct., 09.06.09, Indiana State Police Pension Trust v. Chrysler LLC, Per Curiam).

Suspension : en déterminant s’il convient d’accorder une suspension, la Cour considère si le requérant a démontré : (1) une probabilité raisonnable que quatre Juges décideront de considérer la question comme présentant des chances de succès suffisantes pour accorder certiorari ou comme conférant juridiction ; (2) une perspective équitable qu’une majorité de la Cour conclura que la décision inférieure était erronée ; et (3) une probabilité qu’un dommage irréparable résultera d’un refus d’accorder une suspension. La Cour rappelle en outre qu’une suspension n’est pas un droit, même si un dommage irréparable est susceptible de résulter du refus de l’accorder.
