Barber v. Thomas



Sentencing: good time credit: the federal sentencing statute at issue provides that a “prisoner . . . serving a term of imprisonment of more than 1 year . . . may receive credit toward the service of that sentence . . . of up to 54 days at the end of each year” subject to the Bureau of Prison’s (BOP) “determination . . . that, during that year, the prisoner” has behaved in an exemplary fashion. 18 U. S. C. §3624(b)(1); when the difference between the time remaining in the sentence and the amount of accumulated credit is less than one year, the BOP awards a prorated amount of credit for that final year proportional to the awards in other years; because the BOP’s method for calculating good time credit reflects the most natural reading of the statute, it is lawful (U.S.S.Ct., 07.06.10, Barber v. Thomas, J. Breyer).

Pénalité : diminution du temps d’incarcération pour bonne conduite : la loi fédérale prévoit qu’un prisonnier qui exécute une peine d’emprisonnement de plus d’une année peut bénéficier d’une réduction de la durée de l’emprisonnement pour bonne conduite, cela jusqu’à 54 jours, à la fin de chaque année, décision sujette à la détermination du Bureau de la prison. Quand la différence entre la durée du solde de la peine et la durée du crédit accumulé est de moins d’une année, le bureau accorde pour cette dernière année un montant de crédit calculé au prorata des montants accordés pour les autres années. La méthode de calcul retenue par le Bureau est le reflet de la lecture la plus naturelle de la loi, de sorte que cette méthode est conforme au droit.
