Case or controversy: This preenforcement challenge to
§2339B is a justiciable Article III case or controversy. Plaintiffs face “a
credible threat of prosecution” and “should not be required to await and undergo
a criminal prosecution as the sole means of seeking relief.” Babbitt v. Farm
Workers, 442 U. S. 289, 298 (cf. same decision under “terrorist
organizations”) (U.S.S.Ct., 21.06.10, Holder v.
Humanitarian Law Project, C.J. Roberts).
Pour
