Holder v. Humanitarian Law Project



Case or controversy: This preenforcement challenge to §2339B is a justiciable Article III case or controversy. Plaintiffs face “a credible threat of prosecution” and “should not be required to await and undergo a criminal prosecution as the sole means of seeking relief.” Babbitt v. Farm Workers, 442 U. S. 289, 298 (cf. same decision under “terrorist organizations”) (U.S.S.Ct., 21.06.10, Holder v. Humanitarian Law Project, C.J. Roberts).

Pour permettre à la Cour de juger un cas comme recevable, il doit exister un litige actuel, qui permet une résolution judiciaire.
